I think Rare will reprogramm the Banjo games(with updated graphics etc) to make them run directly from Xbox360 hardware. I see no other possibility.
I don't think that's the problem, a third party N64 emulator would contain no Nintendo code and there are already ones for PC and other platforms (and they're not technically illegal by themselves, only the roms are).

I'd love to see them, but we have a better chance of seeing Banjo. Nintendo published it.
Microsoft bought the rights to the whole Banjo series, so although Nintendo published it I don't think that counts anymore, it's Microsoft's game. That's how I understand it anyway. I guess it could technically be on Xbox 360 (like I said above) - although I don't know what would happen about the Nintendo logo at the start.

Yeah, that's very possible now that they're supposedly planning to release a sequel. That's what they did with Conker's Bad Fur Day, after all.

Wait a minute... Donkey Kong 64 CAN'T be on virtual console, you can play jetpac on Dk64 right? And Microsoft owns jetpac! there is a new jetpac game on 360 live arcade! that means no Dk64...

I hate suggesting this, but Nintendo could always just cut out Jetpac. Hey, they've cut out pretty much everything else in their VC games that could even REMOTELY cause a lawsuit to be filed against them.
