It's upto Microsoft I believe who probably aren't willing to co-operate given an XBLA remake of Perfect dark is currently in deve
lopment.
Apparently we'd have goldeneye on VC already but Nintendo didn't want it on XBLA too or something so nothing was able to come of this gem.
